Michigan introduces bill to ban court use of international law

For example, sharia law. If ever there were a state that needed it. via Bans on court use of sharia/international law: Michigan becomes 22nd state to consider, Texas House tries again to get Senate to adopt » Gavel to Gavel.

With Alabama, Iowa, And North Carolina all set to adjourn in June, it looked as if there would not be any additional sharia/international law bans introduced or debated in 2011. However, in mid-June Michigan introduced a bill (HB 4769) co-sponsored by 42 of 63 Michigan House Republicans that copied much of the language from the versions introduced in Iowa, Kansas, Maine, Missouri, South Dakota, and West Virginia, in particular the use of the term “informal tribunals” or “informal administrative body” in all of these versions, something that does not appear in the others.

If parties choose to subject themselves to sharia law in a jurisdiction outside of Michigan or the U.S., House Bill 4769 (2011) would seem to accommodate that:

(4) If a corporation, partnership, limited liability company,  business association, or other legal entity contracts to subject itself to foreign law in a jurisdiction outside of any state or territory of the United States, this act does not apply to that contract.

Bill Raftery at Gavel to Gavel has a listing of 49 bills in 22 states of which the overwhelming majority have failed.

The list and his statuses don’t seem to be complete as noted in this post, Tennessee and Louisiana passed variations of the American Public Policy Alliance’s “American Law for American Courts” legislation in 2010. Neither are on Raftery’s list, which may only refer to action taken in 2011. (Update: See Mr. Raftery’s comment and link below)

Even if Raftery is directionally correct, 20 states have rejected bills to ban international and/or Islamic sharia law. Another, Oklahoma, overwhelmingly approved of the legislation only to have terror-linked, pro-sharia law CAIR intervene and a rogue judge deny the will of the people.

The rate of failure is concerning in light of evidence that a new study found Shariah law involved in at least 50 court cases in 23 States. Understanding the study used a random sampling of publicly available information from one source, there are likely many more cases as well.

Some of these bills may be badly written. Many of your elected officials may be completely ignorant on the topic of Islamic sharia law, how it affects American citizens and how it has been used in American courts. Some of your elected officials may be influenced by those who are pro-sharia, such as CAIR, ISNA, MAS, MSA, Keith Ellison, the Saudi’s, and others.

Contact your elected officials and refer them to the Public Policy Alliance for starters, and some of the links above as well so they can try, try again.

  1. Do you want Sharia Law to get a foothold in American courts throughout the United States? H.R. 973 has been introduced and needs to be advanced in Congress and made into law. Every Congressmen who does not vote affirmative for this law needs to be “exposed” to the American people.

    What is H.R. 973? This is a simple, short bill designed to protect Americans from being forced under laws which we did not enact, but were enacted by foreign powers or foreign peoples. The motivation for this bill is primarily that the sponsors do not want judges to use Shariah law, but this bill would apply to any foreign law which judges might use to subvert the Constitution or the will of the people of the United States. We are a sovereign nation.

  2. Arizona also passed legislation. Gavel to Gavel is wrong on several of the bills and legislation is alive and moving in several states that Gavel to Gavel reports it as failing.

  6. It’s incredible that you have to pass a law in the US mandating that courts use US law.

  7. Certainly dearbornistan gets a pass if this bill is passed. It wouldn’t be fair to shari’s abiding residents and elected officials to humiliate them with something like this coming from NATIVES.

  8. What, Michigan may see a problem with letting all of the “Peaceful” Muslims take over their welcoming state? I’m Surprised it took them this long with all of the crap they have been doing there.
    Sharia Law should be outlawed in the entire United States because it is sedition in the fact that the people pushing it want to replace our Constitution with their 7th Century hate filled way of life.
    I suspect more states to make laws that outlaw Sharia Law since our Government does nothing in these matters. Once an area sees what the radical Muslims are really about it doesn’t take long to know it is not good.
    Freedom and Free Speech are the enemies of Islam. Learn what is going on in your area before you are forced to convert or be killed. That’s the way their rules say in the Quran they follow.

  12. Do any of you actually live in Michigan? Specifically in Metropolitan Detroit? What about the fact that the First Amendment forbids the use of any religion in legal proceedings?

    There’s a disturbing, yet delicious irony in that you are perfectly willing to violate the Rights of others at the same time you claim your own are being encroached upon. There is little difference in the fundamentalism preached by Dominionists and the Taliban, beyond cosmetic ones of language and symbols.

    Both groups seek to make the ruling government into a theocracy, based on the text of a religious document. Both subjugate women, by taking away their rights as citizens. There are no spiritual remedies for women who are raped, no matter how old they are- they must bear the blame for tempting the men, and must carry the child to term whether or not the father will be there to support that child. Art is restricted by the message- no offensive images are tolerated. Commerce is regulated only by the people conducting the transaction, with no expectation of fairness to those who cannot afford the price.

    For those that complain about having their religious freedoms violated, you’re awfully quick to deny them to anyone else you don’t agree with. If you don’t want anyone forcing their faith down your throat, why don’t you have any qualms about forcing yours upon them?
