SAN FRANCISCO — A federal judge in San Francisco has ruled that trendy clothing retailer Abercrombie & Fitch wrongly fired a Muslim worker who insisted on wearing a head scarf.

U.S. District Judge Yvonne Gonzalez Rogers said the company violated anti-discrimination laws when it fired Hani Khan from its Hollister store in San Mateo, Calif., in 2010. Rogers issued the ruling on Tuesday.

The company claimed the head scarf violated its policy governing the look of its employees, which it said was part of its marketing strategy.

The store argued that deviating from its look policy would affect sales. But the judge said Abercrombie & Fitch offered no “credible evidence” that Khan’s head scarf cost the company any sales.

“Abercrombie only offers unsubstantiated opinion testimony of its own employees to support its claim of undue hardship,” Rogers said.

The U.S. Equal Employment Opportunity Commission filed a lawsuit on Khan’s behalf in 2011.

“Abercrombie & Fitch does not discriminate based on religion and we grant religious accommodations when reasonable,” spokesman Bruce MacKenzie said. “It is our policy not to comment on pending litigation.”

A trial on the company’s liability is scheduled for later this month. The judge said the jury is free to award punitive damages if it chooses.

It’s the latest employment discrimination charge against the company’s so-called “look policy,” which critics say means images of mostly white, young, athletic-looking people.

The New Albany, Ohio-based company has said it does not tolerate discrimination.

  1. There will be all sorts of “religions” asking for these types of accommodations. It’s almost as if we’re not in America anymore. I believe that a company has a right to set a dress code, and if you don’t want to or can’t conform to it, get employment elsewhere. Was this really about or employment or about making a STATEMENT?

  2. Soon, women won’t be able to find work if they don’t wear hijabi in America. It will be coming soon as Sharia Law is popping up everywhere.

    • I hope they stand up for their opinion. That is religious garb and deeply offends me. Anyone in that crap they wear will NOT help me in any way. If I see one working in a store I will leave. I study Islam and I know why they wear it. They do NOT have to. There is a purpose and I will not succumb to it. It would be like me working somewhere with a Bible around my neck. My God and my husband are better than that and do not demand it. I can have a personal relationship with God without an outward sign except hopefully others seeing my Christian values and morals and inner peace that can come only from God the Father, His Son, and The Holy Spirit. That is all I need.

    My kids are not allowed to shop in or but A&F clothing be cause of their controversy. But I do support their right to a dress code.

    Again, why would this woman even want to step foot in A&F? I smell a rat.

    • I think you have something here. CAIR makes huge strides because they have everyone scared of them. And they have roaches to do their bidding.

  7. The hijab is worn to oppress the female because of supposed modesty as if a person’s head is a sex organ. It is ridiculous.

    They are intimidated by there elders from youth to wear this oppressive wear that does not allow your head to breath which is not healthy.

    If muslim men who love to practice taqiyah(lie/decieve)by saying that they are for equal rights for women than I say then they should half to wear the hijab themselves especially the one that covers there entire head including a type hijab that would cover there offensive crazed eyes which are ugly as hell.

  8. OK, let me get this straight. Now, the Federal Government can now tell employers that it cannot enforce a specific dress code. What’s next, schools will be told that they cannot enforce no hoods or headgear? Wake up people, were allowing Islam to not only run our country but to ruin it.

    • They usually don’t wear them then, just after they get the job. The bitch need a burqa to hide her ugly face.

      • Than she purposely did this, and abused our system of law. Should be deported without question. We should not buy, rent or sell to Muslims because it is only trouble waiting to happen.

  10. Don’t hire Muslims. It’s just that simple. They will lie to you then sue you and ruin your life and business. If I’m shopping and a woman sales clerk in a body bag approaches me, I simply walk away. Harder to tell with a guy. No Islamopandering!

    This Muslim chick was probably a CAIR plant from the get go. It’s called “lawfare”, but you guys know that already.
